The BCBS Provider Settlement addresses allegations that BCBS engaged in anticompetitive practices by dividing the U.S. into exclusive service areas and fixing reimbursement rates. As a result, providers may have received reduced payments for services rendered. Rather than continuing litigation, BCBS has agreed to a $2.8 billion settlement fund to compensate eligible providers.

Physicians licensed before March 12, 2008, are generally excluded unless they opted out of the Love v. Blue Cross Blue Shield Association settlement. However, because there is no way to verify opt-outs from that case, these physicians should assume they cannot file a claim.
Opting out allows you to retain your right to sue the BCBS defendants separately. The deadline to opt out is March 4, 2025.
